Sollte ich meine Bilder auf anderen Internetseiten, anderen Galerien auf xHamster oder in irgendwelchen Foren wiederfinden so wird die Beauftragung eines Anwalts zur Einbringung einer Klage nach dem UrhG unumgänglich. Gem. § 50 Abs. 2 Z 10 (JN) ist nämlich für Streitigkeiten aus dem Urheberrecht unabhängig vom Streitwert immer das Landgericht zuständig und dort besteht Rechtsanwaltszwang. Da die Kosten einer derartigen Klage nicht unbeträchtlich sind, sollte man sich daher im vorhinein überlegen, ob es sich auszahlt Bilder an denen man keine Rechte hat zu veröffentlichen. Zusammengefasst kann man also sagen ... Vorsicht! Urheberrecht- bzw. Copyright-Verletzungen können sehr teuer werden.

Mit Urteil vom 12. Mai 1998 - 312 O 85/98 - "Haftung für Links" hat das Landgericht (LG) Hamburg entschieden,
dass man durch die Anbringung eines Links, die Inhalte der gelinkten Seite ggf. mit zu verantworten hat. Dies kann - so das LG - nur dadurch verhindert werden, dass man sich ausdruecklich von diesen Inhalten distanziert. Hiermit distanzieren wir uns ausdrücklich von allen Inhalten die in Seiten zu finden sind, die auf unserer Homepage oder Linklisten-Verzeichnis gelinkt werden und machen uns diese Inhalte nicht zu eigen.

According to § 50 para. 2 no. 10 (JN), the district court is always responsible for disputes arising from copyright irrespective of the value in dispute, and there is a legal requirement. Since the costs of such a lawsuit are not insignificant, you should consider in advance whether it pays off to publish pictures to which you have no rights. In summary, one can say ... Caution! Copyright violations can be very expensive.

With judgment of May 12, 1998 - 312 O 85/98 - "Liability for links" the district court (LG) Hamburg decided
that one has to be responsible for the content of the linked page by placing a link. According to the district court, this can only be prevented by expressly distancing yourself from this content. We hereby expressly distance ourselves from all content that can be found on pages that are linked on our homepage or link list directory and do not adopt this content as our own.
